N S F Check Statute Overview

The NSF check laws within the state of Michigan have been vague and unclear in the past. Everyone sort of did their own thing, depending upon who said what to whom. In January 1999, the ability to collect on theft and bad checks was clarified. Listed below is a summary for creditors:

Your initial demand letter may be sent by first class mail.

bullet

Use of an agent (professional collection company) is now permitted.

bullet

If the check is paid within 7 days of receipt of the letter, you may collect a fee of $25.00.

bullet

If the check is paid after 7 days of receipt of the letter, you may collect a $35.00 processing fee.

bullet

If you file a Civil Complaint, until trial date you may collect the amount of the check, $35.00 processing fee and costs not to exceed $250.00, as agreed to by the parties.

bullet

If you are not paid, under Civil Complaint, you are entitled to twice the amount of the check (but not less than $100.00) and costs of $250.00.
